It is reported that Temu, a shopping platform owned by Pinduoduo, which has entered the overseas market with ultra-low prices and high profile, has recently been involved in a dispute with Amazon sellers.
The reason is that some merchants on Temu directly move the listings sold by sellers on the Amazon platform to Temu and sell them at a much lower price than the original listing, attempting to obtain more sales at a lower price. This behavior may constitute an infringement of Amazon sellers’ intellectual property rights.
According to Reuters, in May this year, Wang Feixiang, CEO of China based Maibo Technology, sued Temu in the North District Court of Illinois, claiming that after “seeing the success of FitBeast fitness equipment,” Temu and its suppliers copied and sold products to steal his “commercial success.
Wang said he found sports equipment with FitBeast brand labels on Temu for less than $5, but the company’s product is priced at $25.99 on Amazon. He is worried about being punished for Amazon’s fair pricing policy.
Shenzhen Kangmingcheng Technology, which sells Hicober brand microfiber hair bath towels for $29.99 on Amazon, also accused Temu of infringement in a lawsuit filed in April. The lawsuit claims that Temu has a similar headscarf priced at $5.88.
At present, Temu officials have not provided a response to this. But according to Temu’s statement on its website, it has a “strict policy against listing or selling products that infringe on third-party trademarks, copyrights, or patents.
The statement states that Temu “does not actively participate in the listing and sale of seller’s items”, and sellers are responsible for obtaining necessary permits for their stores.
According to court documents, the pending US lawsuit is one of the first legal disputes between Amazon sellers and Temu.
